Agreement to Terms

Welcome to CreatorGuard. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CreatorGuard (“Company,” “we,” “our,” or “us”) governing your access to and use of the CreatorGuard platform, website, and related services (collectively, the “Service”).

By accessing or using CreatorGuard, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


1. Description of Service

CreatorGuard is a content protection platform that provides:

  • Plagiarism Detection: Scanning and monitoring of web content for unauthorized copies
  • DMCA Protection: Generation and tracking of Digital Millennium Copyright Act takedown notices
  • SEO Optimization: AI-powered recommendations and audits for search engine optimization
  • WordPress Integration: Direct connection to WordPress sites for content monitoring
  • Analytics Dashboard: Reporting and insights on content protection activities
  • Backdated Licensing: Revenue recovery options for content theft (where applicable)

2. Eligibility

To use CreatorGuard, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Service under applicable laws
  • Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


3. Account Registration

3.1 Account Creation

To access certain features, you must create an account by providing:

  • A valid email address
  • A secure password
  • Any additional information requested during registration

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong, unique passwords

  • Update your information to keep it accurate
  • Not create accounts using false or misleading information
  • Not create multiple accounts to circumvent limitations

4.2 Free Trial

  • 14-day free trial available for the Creator plan
  • No credit card required for trial signup
  • Full access to Creator plan features during trial
  • Automatic conversion to paid plan if payment method is added

4.3 Billing

  • Subscriptions are billed monthly or annually in advance
  • Annual billing includes a discount (equivalent to 2 months free)
  • Taxes (sales tax, VAT) are applied based on your location
  • All prices are in USD unless otherwise specified

4.4 Payment Processing

  • Payments are processed securely through Stripe
  • We accept major credit cards (Visa, Mastercard, American Express, Discover)
  • Debit cards are also accepted
  • Enterprise customers may request NET-30 invoice terms

4.5 Price Changes

We reserve the right to modify pricing with 30 days’ advance notice. Price changes will not affect your current billing cycle.


5. Credits and Usage

5.1 AI Credits

  • AI credits are used for SEO optimization features
  • Credits reset monthly on your billing date
  • Unused credits do not roll over to the next month
  • Additional credits can be purchased as needed

5.2 Plagiarism Words

  • Word limits apply to plagiarism scanning
  • Limits reset monthly on your billing date
  • Usage is tracked per scan request
  • Exceeding limits requires plan upgrade or additional purchase

5.3 Fair Use

You agree not to:

  • Abuse or exploit the credit/word systems
  • Use automated tools to artificially inflate usage
  • Share account access to circumvent plan limitations
  • Resell or redistribute service access

6. WordPress Integration

6.1 Connection Method

CreatorGuard connects to WordPress sites using Application Passwords, the official secure authentication method introduced in WordPress 5.6.

6.2 Access Scope

When you connect your WordPress site, you grant CreatorGuard permission to:

  • Read posts, pages, and content
  • Access metadata (titles, excerpts, categories, tags)
  • Retrieve media library information
  • Access SEO metadata for optimization

6.3 Limitations

CreatorGuard cannot and will not:

  • Access your WordPress admin password
  • Modify your site’s content or settings
  • Access user accounts or visitor data
  • Install, modify, or delete plugins
  • Access your hosting credentials

6.4 Revocation

You may revoke access at any time through your WordPress dashboard without notice to us.


7. DMCA Services

7.1 DMCA Notice Generation

CreatorGuard provides tools to generate DMCA takedown notices. By using this feature, you:

  • Confirm you are the copyright owner or authorized agent
  • Attest that the information provided is accurate
  • Understand that false claims may have legal consequences
  • Accept responsibility for notices sent using our platform

7.2 Disclaimer

CreatorGuard:

  • Provides notice generation tools, not legal advice
  • Does not guarantee the success of takedown requests
  • Is not responsible for responses from third parties
  • Recommends consulting legal counsel for complex matters

7.3 Counter-Notices

If you receive a counter-notice, you may need to pursue legal action. CreatorGuard can provide documentation support but is not a party to such disputes.


8. Intellectual Property

8.1 Our Intellectual Property

CreatorGuard and its licensors own all rights to:

  • The Service, including software, algorithms, and technology
  • Our trademarks, logos, and branding
  • Documentation, content, and materials we provide
  • Any improvements or modifications to the Service

8.2 Your Content

You retain ownership of:

  • Content you submit for scanning
  • Your website content and intellectual property
  • DMCA notices you generate (as to the underlying claim)

8.3 License to Us

By using the Service, you grant us a limited license to:

  • Process your content for plagiarism detection
  • Store scan results and reports
  • Use anonymized data for service improvement
  • Display content excerpts in reports and dashboards

This license is:

  • Non-exclusive and revocable
  • Limited to providing the Service
  • Subject to our Privacy Policy

9. Acceptable Use Policy

9.1 Permitted Uses

You may use CreatorGuard to:

  • Protect content you own or are authorized to protect
  • Generate legitimate DMCA notices for your copyrighted works
  • Monitor your content across the web
  • Optimize SEO for your websites

9.2 Prohibited Uses

You may NOT use CreatorGuard to:

Fraudulent Activities:

  • Submit false DMCA claims
  • Misrepresent copyright ownership
  • Harass or intimidate others
  • Engage in any illegal activity

Abuse of Service:

  • Attempt to bypass usage limits or security measures
  • Reverse engineer, decompile, or disassemble the Service
  • Use bots or automated tools not provided by us
  • Interfere with or disrupt the Service

Harmful Content:

  • Submit content that is illegal, defamatory, or harmful
  • Use the Service for spam or phishing
  • Violate the rights of third parties
  • Distribute malware or malicious code

9.3 Consequences

Violation of this Acceptable Use Policy may result in:

  • Warning or temporary suspension
  • Immediate account termination
  • Forfeiture of fees paid
  • Legal action if warranted

10. Disclaimers

10.1 Service Provided “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS

10.2 No Guarantee

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Plagiarism detection will catch all copies
  • DMCA notices will always be successful
  • SEO recommendations will achieve specific results
  • Third parties will comply with takedown requests

10.3 Not Legal Advice

CreatorGuard provides tools and information, NOT legal advice. For legal matters, consult a qualified attorney.


11. Limitation of Liability

11.1 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATORGUARD’S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid to CreatorGuard in the 12 months preceding the claim, OR
  • One hundred dollars ($100)

11.2 Exclusion of Damages

IN NO EVENT SHALL CREATORGUARD BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data or goodwill
  • Damages from third-party actions or failures
  • Damages resulting from unauthorized access to your account

11.3 Exceptions

Some jurisdictions do not allow certain liability exclusions. In such cases, our liability will be limited to the maximum extent permitted by law.


12. Indemnification

You agree to indemnify, defend, and hold harmless CreatorGuard and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • False or fraudulent DMCA claims you submit
  • Content you submit to the Service

13. Termination

13.1 Termination by You

You may cancel your subscription at any time:

  • Through your account settings
  • By contacting support
  • Cancellation takes effect at the end of your billing period

13.2 Termination by Us

We may suspend or terminate your account:

  • For violation of these Terms
  • For non-payment of fees
  • For fraudulent or illegal activity
  • At our discretion with 30 days’ notice

13.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease
  • Your data will be retained for 30 days, then deleted
  • You remain liable for any outstanding fees
  • Provisions that should survive (indemnification, limitation of liability) will survive

13.4 Refunds

  • Monthly subscriptions: No refunds for partial months
  • Annual subscriptions: Pro-rata refund may be available at our discretion
  • Refunds are not available for credits already used
  • Enterprise agreements may have custom refund terms

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the matter informally for at least 30 days.

14.2 Arbitration Agreement

Any disputes not resolved informally shall be resolved through binding arbitration, except for:

  • Claims that may be brought in small claims court
  • Injunctive relief for intellectual property violations

14.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATION.

14.4 Governing Law

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.


15. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on our website
  • Updating the “Last Updated” date
  • Sending email notification for significant changes

Your continued use of the Service after changes constitutes acceptance. If you do not agree to the changes, you must stop using the Service.


16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and CreatorGuard.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

16.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.

16.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control.
